Terms & Conditions of Sale — Original Artwork/Commissions

These Terms & Conditions apply to all purchases, commissions, and sales of original artwork made by Caleb Elliott (“Artist,” “I,” “me”).

By purchasing artwork from the Artist, the buyer (“Collector,” “Client,” “you”) agrees to the following terms:

 

1. Original Artwork

All works sold as “original” are one-of-a-kind, hand-created pieces unless otherwise stated.

Each original artwork may include:

  • A signed certificate of authenticity

  • Artist signature on front and/or back

  • Documentation of medium, title, and year created

 

2. Pricing

All prices are listed in USD unless otherwise stated.

Prices may change at any time prior to purchase. Once payment is received, the sale price is locked.

Pricing reflects:

  • Artistic labor and creative value

  • Materials and studio costs

  • Professional experience and market demand

 

3. Payment Terms

Accepted payment methods include:

  • Credit/debit card

  • PayPal

  • Bank transfer

  • Other approved payment platforms

Full payment is required before artwork is shipped or released, unless a written installment plan has been agreed upon.

 

 Sales Are Final

Due to the unique nature of original artwork:

All sales of original works are final.

We do not accept returns or exchanges except in cases of damage during shipment (see Section 8).

Collectors are encouraged to ask questions and request additional images before purchasing.

 

5. Shipping & Delivery

Shipping costs are calculated separately unless explicitly included.

Artwork is shipped using professional packaging to ensure protection.

Estimated shipping timelines:

  • Domestic (U.S.): 5–14 business days

  • International: 2–6 weeks depending on customs

The Artist is not responsible for delays caused by carriers or customs processing.

Artwork is considered delivered once released to the buyer.

 

7. Risk of Loss

Responsibility transfers to the buyer once the artwork is delivered to the shipping carrier.

Insurance may be included or offered as an add-on for high-value works.

 

8. Damaged Artwork Claims

If artwork arrives damaged:

  1. Buyer must contact the Artist within 48 hours of delivery

  2. Buyer must provide clear photos of:

    • Damage to artwork

    • Packaging materials

    • Shipping box

Claims submitted after 48 hours may not be eligible for reimbursement.

 

If damage is confirmed, the Artist may offer:

  • Repair (if possible)

  • Replacement (if available)

  • Refund (at Artist discretion)

 

9. Certificates of Authenticity

Original works may include a signed Certificate of Authenticity.

Certificates are not transferable separately from the artwork and may not be reproduced.

 

10. Copyright & Intellectual Property

Purchase of an artwork does not transfer copyright.

The Artist retains all rights, including:

  • Reproduction

  • Prints

  • Licensing

  • Digital display

  • Promotional use

Collectors may not reproduce the artwork for commercial purposes without written permission.

 

11. Collector Display Rights

Buyers may display purchased artwork in:

  • Private homes

  • Personal collections

  • Offices (non-commercial reproduction)

Artwork may not be used in advertising, merchandise, NFTs, or resale branding without licensing agreement.

 

12. Resale & Secondary Market

Collectors may resell artwork, but:

  • The Artist retains the right to be credited as creator

  • The artwork may not be altered or misrepresented

  • Artist requests first right of refusal when possible

(Resale royalty rights may apply depending on jurisdiction.)

 

13. Commissions

Commissioned works require:

  • Signed agreement

  • Non-refundable deposit (typically 30–50%)

  • Approval of concept before completion

Custom commissions are final sale and not eligible for return.

 

14. Taxes & Duties

Buyers are responsible for:

  • Sales tax (if applicable)

  • International import duties and customs fees

 

15. Fraud Prevention

The Artist reserves the right to cancel orders suspected of fraud or unauthorized payment activity.

 

16. Limitation of Liability

The Artist is not liable for indirect or consequential damages arising from the purchase or use of artwork beyond the purchase price.

 

17. Governing Law

These Terms shall be governed by the laws of:

State of California, United States

Any disputes must be resolved in that jurisdiction.
